Terms and Conditions

1. Object
These conditions govern the sales of the entreprise individuelle Terra Mate, micro-entrepreneur, located at 121 Rue Fontcouverte, 34070 Montpellier, registered at the Chambre des métiers et de l’artisanat under number SIRET 90986868900011.
The applicable T&Cs are those in force on the Site on the date the order is placed by the Customer; it being specified that any order of a Product offered on the site www.terra-mate.com implies the full and entire adherence of the Customer to the T&Cs in force at the time of placing his order.
Terra Mate reserves the right to update, change or replace any part of the T&Cs by publishing a new version with the updates on the Site.

2. Products
The products offered are those which appear on the site www.terra-mate.com within the limits of available stocks. Terra Mate reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description containing its main technical characteristics (dimensions, use, composition, etc.). The photographs are as faithful as possible but do not commit Terra Mate in any way. As each product is made with artisanal techniques, slight variations in color, shape and size may occur and cannot be considered as defects.
In the absence of availability of one or more Product(s), Terra Mate undertakes to inform the Customer thereof when entering the order and/or after validation of the order by sending an email to Customer by Terra Mate. If the order has already been validated and payment for the order has been made, Terra Mate undertakes to reimburse the Customer. Terra Mate cannot be held responsible in the event of the unavailability of one or more Product(s).
The Products are intended for personal use only and not for the purpose of resale. When placing an order, the Customer certifies that he is buying the Products for personal use and not to resell them.

3. Price
The prices indicated by Terra Mate on the site are displayed in euros, do not include delivery costs and are indicated inclusive of tax, TVA not being applicable for micro-enterprises according to article 293 B of the CGI.
In the event of an order to a country other than metropolitan France, the Customer is the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of Terra Mate. They will be the responsibility of the Customer and are his full responsibility, both in terms of declarations and payments to the competent authorities and bodies of his country.
All orders, whatever their origin, are payable in euros. Terra Mate reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time of the validation of the order and subject to availability. The products remain the property of Terra Mate until full payment of the price.
Please note: as soon as the Customer takes physical possession of the products ordered, the risk of loss or damage to the products is transferred to him.

4. Order
The Customer can place an order on the website www.terra-mate.com.
The Customer can select as many Products as he wishes which will be added to the basket. The basket summarizes the products chosen by the Customer as well as the prices and costs relating thereto. The Customer may freely modify the basket before confirming his order.
Any order appearing on the website www.terra-mate.com implies acceptance of these General Conditions. Any order confirmation entails the Customer's full acceptance of these general conditions of sale, without exception or reservation. All the data provided and the recorded confirmation will constitute proof of the transaction. The order confirmation will constitute signature and acceptance of the operations carried out.
A confirmation email summarizing the Order (product(s), price, availability of the product(s), quantity, etc.) will be sent to the Customer by Terra Mate. To this end, the Customer formally accepts the use of email for confirmation by Terra Mate of the content of his order.
5. Payment
The fact of validating your order implies for you the obligation to pay the indicated price. Payment for your purchases is made by credit card using the secure Stripe system.
The Customer acknowledges that the communication of his credit card number constitutes authorization to debit his account for the amount of the products ordered and all taxes included. The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers. If the card issuer refuses to authorize payment to Terra Mate, the order will be cancelled.
6. Delivery
The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page. When entering the order on the site, the Customer must choose the method of Delivery (at home or by person at the workshop of Terra Mate: 121 Rue Fontcouverte, 34070 Montpellier) and the place of Delivery.
The amount of the delivery costs is calculated according to the destination, the weight of the package and the delivery method chosen.
Shipping is done as soon as possible, on average 2 to 5 working days. In any case, the delivery must take place within 30 days of the online order. For custom orders, the delivery time is set by mutual agreement between Terra Mate and the buyer.
In the event of an error in the Customer's contact details, Terra Mate cannot be held responsible for the impossibility of delivering the product(s) ordered.
In case of late shipment, an email will be sent to you to inform you of any consequences on the delivery time indicated to you.
In the event of deliveries by a carrier, Terra Mate cannot be held responsible for late delivery due to the unavailability of the customer after several appointment proposals.
Any anomaly concerning the delivery (missing object, incorrect model/color combination, damaged package) must imperatively be notified within 14 days to Terra Mate by e-mail addressed to terramateatelier@gmail.com. Any complaint made after this period and Terra Mate will be released from all liability. Terra Mate reserves the right to ask the buyer to return the defective product. Return costs will be the responsibility of the buyer unless the return is due to an error on the part of Terra Mate. If the above conditions are met, Terra Mate will then either refund the defective product(s) or reship the missing or broken product.

7. Returns
In accordance with the provisions of Article L.121-21 of the Consumer Code, the Customer has a return period of 14 days from receipt of the products to exercise his right of return without having to justify reasons or to pay a penalty. Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, the responsibility of the Customer is engaged. Any damage suffered by the product on this occasion may eliminate the right of return. Return costs are the responsibility of the Customer. In the event of exercise of the right of retur, Terra Mate will reimburse the sums paid, within 14 days of notification of the Customer's request and via the same means of payment as that used when ordering.
8. Data Protection
Some personal information collected is mandatory in the context of distance selling. This information is necessary for the processing of the order, the delivery and the establishment of invoices. In the absence of this information, the order will be automatically rejected. Terra Mate is committed to maintaining the confidentiality of this information. The way in which the User's personal data is collected, processed and protected is detailed in the Privacy Policy available on the site.
9. Warranty
All products supplied by Terra Mate benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to Terra Mate who will take it back, exchange it or refund it. All complaints, requests for exchange or refund must be made by email to terramateatelier@gmail.com within 14 days of receipt of the order.
Terra Mate in the distance selling process is only bound by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems; any other involuntary problem or any event qualified as force majeure, in accordance with case law, including, in particular, a strike by the postal services, a shortage of stock at the supplier's, the destruction or total or partial loss of the stock, the stoppage of the production of a model or any other cause of which Terra Mate would not have been informed as well as any other exceptional event.
To the maximum extent permitted by applicable law, Terra Mate assumes no responsibility for errors or inaccuracies in content, personal injury or property damage of any kind arising from accessing or use of the Terra Mate service by the User; and any unauthorized access to or use of secure servers and/or any personal information stored therein.
10 - Applicable law and disputes
These general conditions are governed by the law of the French Republic. The competent jurisdiction to examine any disputes is the Court of Versailles.
